Minnesota Vikings defensive tackles Pat Williams and Kevin Williams have won a big victory in their efforts to avoid being suspended by the National Football League
KSTP-TV in Minneapolis is reporting that Judge Gary Larson has issued a temporary restraining order against the NFL. That means, for now, that Williams and Williams should be allowed to play Sunday. The Williamses said they were heading straight from the courthouse to the Vikings’ practice facility.
However, this is far from over. KSTP reports that another hearing is expected in the next few days.

Hey Florio….Judge Gary Larsen …as in Purple People Eaters, just kidding……however rumor has it if Judge Larsen is overturned, the Vikes will take it to the Mn Supreme Court where Judge ALAN PAGE currently sits…….NFL might as well give up, the cards are stacked against them, lol

Good for them and hopefully it sticks. The NFL should have directly notified players of it since they were aware of it. Hopefully the Saints players can get the same.

Thank you, Judge Homer. Now, the “cream” and “clear” will be back to lose to Detroit, only. Now, if they were to make the playoffs the “cream” and “clear” won’t be there.

Couldn’t the TRO potentially be worse for the Vikings? Ie, if they’re allowed to play a couple games, then the TRO runs out, and then the suspension goes into affect, they could miss playoff games?

If I was an elected judge, I would not piss off the Viking nation. When you get some type of high profile situation like this, and considering what has happened, and the amount of people that actually vote for judges, if he doesn’t rule in their favor, he does not have a job when elections come up.
But I think the NFL is giving them all a raw deal. Except the Saints. They deserved it.

No surprise at all that the Williams’ were able to obtain a TRO.
It’s an entirely different ballgame for them to be able to triumph in their pursuit of a preliminary injunction. One of the tests that a plaintiff MUST meet in order to obtain a preliminary injunction is as follows:
That he is likely to suffer irreparable harm in the absence of preliminary relief (i.e. the plaintiff cannot be made whole unless everything is put on “hold” until after the lawsuit is settled).
It’s a pretty strong argument that the Williams’ can be “made whole” after they win the lawsuit by being paid the money that they were due to make during the time that they were suspended.
Remember, it’s not the Vikings who must be “irreparably harmed” - it’s the players themselves who presumably won’t be out a cent of money should they prevail in their lawsuit.
I’m betting that this may not work out well for the Vikes. Although the Williams’ will be able to play against the winless Lions, but will likely miss the last three regular season games and the first playoff game.
They should have taken the suspension like all of the others who rolled the dice with unapproved supplements. In the end, they violated the strict liability policy that was clearly stated. Starcaps was not on the approved list, so it’s on their heads no matter what was known by others.

The drug policy in the NFL is very clear and the responsibility falls on the players. Maybe if they checked with the NFL they wouldn’t have taken Starcaps, or maybe they were just trying to get away with something.
I’m sick of people like these guys and Al Franken in his Senate race - a decision is made by the people who make the rules and these crybabies aren’t happy with it so they sue.
These guys should be banned from the NFL for not following the rules of the NFL. Rules are rules and ignorance is no excuse. Ask any judge. If I broke the law and I said, oh I didn’t know, I would still bear the consequences. What makes these two above that?

Mr. Florio, or anyone else with a J.D.: can you explain whether this court’s jurisdiction can be upheld? I’m not familiar with what happened in the Travis Henry case. It almost seems too easy — a key player on the home team suspended by the NFL for whatever reason — all they have to do is find a homer judge in the state district court. They are guaranteed to at least be able to stall everything. What am I missing here?

Well enjoy this small victory because it means they’ll play this Sunday then be suspended for the last 3 games and the eventual playoff loss (assuming they make the playoffs) when it gets overturned.
