There’s a new alias in the world of NFL players. The infamous moniker of “Ron Mexico” has been replaced by a far less tough-sounding alternative.
Per the New York Post, Giants receiver Plaxico Burress sought treatment for his accidental self-inflicted gunshot wound on Friday night under that name: “Harris Smith.”
The Post also reports that Burress spent 90 minutes after the shooting making calls in an effort to find a hospital where the emergency care would be provided in a discreet manner.
He settled on New York-Cornell, where he gave the phony name and said the incident had occurred at an Applebee’s. Hospital workers recognized that the patient was actually Plaxico Burress, and the hospital failed to report the gunshot wound, despite the clear requirements of New York Penal Law Section 265.25.
Per Section 265.25, ”Every case of a bullet wound, gunshot wound, powder burn or any other injury arising from or caused by the discharge of a gun or firearm . . . shall be reported at once to the police authorities of the city, town or village where the person reporting is located by . . . the physician attending or treating the case; or . . . the manager, superintendent or other person in charge, whenever such case is treated in a hospital, sanitarium or other institution. Failure to make such report is a class A misdemeanor.”
So, basically, the doctor who treated Burress and/or the manager in charge of the facility at the time Burress arrived could end up being Plaxico’s cellmate.
Meanwhile, Burress a/k/a Harris Smith has surrendered to authorities on Monday regarding the shooting. He did not speak to the media as he walked into the police precinct, and he was not visibly limping less than three full days after putting a bullet through his own thigh.
The charges are expected to be felony possession of a firearm and felony reckless endangerment.
But to the extent that Burress is feeling sad about his current situation, he didn’t show it on Sunday night. According to the New York Daily News, Burress was “laughing” about the state of affairs on Sunday night.
“He called me laughing and grinning,” Giants running back Brandon Jacobs said. “He is doing fine. He is feeling good. I called him and made a few jokes about the situation and he laughed — which is what I wanted to hear.”
Remorse and contrition might be better emotions to project at a time when the facts and the law seem to be stacked against Plaxico. His primary audience at this point is the prosecutor who’ll decide whether to throw the book at Burress or cut a deal that lets him walk away with a slap on the wrist to go along with the scar on his thigh.
Though some of our readers think that Burress will skate because of his fame, we think there’s a chance that his fame could do him in. Really, what better way is there to ensure that the citizens of New York realize the consequences of illegally possessing a firearm than to prosecute a high-profile defendant on such charges to the full extent of the law?
The widespread deterrent effect that flows from a criminal trial against a celebrity is extremely valuable to law enforcement. Martha Stewart’s case showed us all that lying to the cops is not tolerated. Barry Bonds’ case demonstrates that perjury isn’t a standard practice whenever someone wants to avoid the consequences of cheating in sports, or any other misconduct they’d prefer to conceal. Scooter Libby’s prosecution proved that the concept of “all’s fair” doesn’t apply to politics. And Mike Vick a/k/a Ron Mexico’s case undoubtedly resulted in the abandonment of dogfighting operations in multiple jurisdictions.
If New York genuinely wants to keep guns from being carried into public places by persons who lack the appropriate permission to do so — and likewise to ensure that the guns don’t go off and injure or kill innocent bystanders — the best way to make it happen might be to make an example out of Plaxico Burress.

I don’t understand. How is their any option for the prosecutors here? Do you mean they have discretion in whether to prosecute “to the fullest extent of the law?” I thought that called for an open investigation into why the DA obstructed justice? Or was that just in the Vick case?

On the other hand, he did take a bullet wound that could have killed him. I’m mixed on this. *If* he was worried because of what happened to his teammate then I can understand carrying - although he should have applied for a permit and desperately needed to lock the gun in his car before going into the night club (hmm, seem to remember something about football players, guns and places that serve alcohol). i just have a hard time balancing ‘whole lotta stoopid’ against a three year mandatory sentence. Anyway, you mentionned about the DA wanting to make a statement. Depending on how Plax handles himself, having him plead to one of the felonies that doesn’t have a mandatory sentence (if one of the two does) would bar him from being able to have a gun (until the judge allows him) and in exchange have Plax star in a series of public service commercials explaining NYC’s gun laws and the hazards of breaking them (focus in on the leg…)

The sad truth of the matter is that if this was a common citizen, they would get the penalty of the infraction. Burress on the other hand with his fame, money, and high priced lawyer will get a slap on the wrist.

Wonder what the over under number of people that were involved will be? Sounds like at least 2 other Giants players (Pierce and Bradshaw), the attending Dr., the hospital manager on duty, the hospital itself, the Latin Quarter Club, and maybe his wife who is an attorney. Don’t forget he used another name including most likely signing the hospital paperwork with that name - so impersonating someone else could be added to the charges.
And some of the players are concerned about him being happy?
This will be tabloid fodder for a while.

If you have followed this story - once the Giants Organization found out about this they contacted the police - setting everything else in motion.
Certainly not a cover up.
Plaxico is a turd, and unfortunately has destroyed what could have been a great legacy - his play last season. Now he has probably played his last game as a Giant. I am sure there may be opportunities for him in Cincinatti, Oakland, or maybe even Dallas. I think the handgun laws are less strict in Dallas, anyway.
At least you won’t have to worry about the Cowboys losing another post season game - since they will not make the playoffs this year.

what about any NJ violations here? Plaxico lives in NJ, and if any state has tougher or as tough gun laws as NY, it’s NJ. Was he licensed to keep a pistol in his NJ house? What about crossing state lines with said pistol? A guy who used to work with my husband got in a traffic accident while traveling through NJ with a pistol in his car, and he got slammed for crossing state lines into NJ with it.

What Plax did is wrong, but to play the other side of the coin didn’t ESPN the mag just have a article about how these guys are targeted for there celebrity? You have two players (Darrent williams and Sean Taylor) who were just killed, and the lineman from Jacksonville was shot and paralised. And there was another rumor that Steve Smith of thed Giants was robbed at gun point. Its a different world out there when you have money and fame and the players need to protect themselves from nutjob Cowboy and Eagle fans.

Re-reading this story, there are a few things that bother me…
1. Burress is carrying a weapon with an out of state CCW permit.
2. Goes to club with a weapon (possibly has a few drinks??), has accidental discharge with weapon.
3. Two teammates are with him during incident, one takes weapon and hides it.
4. Spends 90 minutes on phone looking for hospital that won’t notify police about shooting.
5. Lawyers up real quick…when was team ownership notified?
6. Given two days to turn himself in - ordinary Joe would have been arrested while in the hospital.
7. Team owners try to contact him, he does not return calls. Teammates call him, he’s “laughing” about it - WTF???
What’s wrong with this picture??? Is this the mindset of today’s athletes, or society in general?
This clown is facing time for the weapons charge, and there are at least two others that could be charged for their actions in this case (one for “hiding” the gun, the physician for not reporting treating Burress for the gunshot wound). Plus, he could be suspended from the Giants, without pay, for this incident, and punishment from the league. If he goes to jail, by the time he’s out he’ll be pushing 36 (a year for the trial and 3 1/2 years time in the pen) - on the downside for a wide receiver, especially one that has been away from the game.
Plax…if you go to the hole, don’t tell them you’re a “wide receiver”…

So the gun was retrieved from Plastico’s house… where does Plastico live? If he lives in NJ, would NJ have jurisdiction to charge him (or Pierce, since he allegedly is the guy that moved the gun) with a crime? Obstruction of justice, unlawful transport of an illegal weapon across state lines, etc?
