We mentioned recently that a quote from agent Gary Uberstine suggested that former Raiders coach Lane Kiffin might be thinking about suing owner Al Davis for that attempt to verbally give Kiffin a second exit route for digested foodstuffs.

Jay Glazer of FOX reports that those close to Kiffin are urging him to file a defamation lawsuit. 

Kiffin’s grievance for unpaid wages will be submitted to the Commissioner this week, since the standard coaching contract requires any such controversies to be pursued in that owner-friendly forum.

But because the statements made by Davis against Kiffin came after the employment relationship ended, Kiffin should be able to file suit in a court of law against Davis.

The argument in favor of suing is that Kiffin’s future earnings could be harmed by the things Davis said about the young coach.  The argument against such a move would be the damage that Kiffin could due to his future earnings by coming off as excessively litigious.
