After several hours of uncertainty and confusion regarding the condition of Hall of Famer Gene Upshaw, it has been confirmed by NFL.com that Upshaw has died of pancreatic cancer.
He turned 63 just last Friday.
It’s still unknown whether he had been fighting the disease for an extended period, or whether he was diagnosed recently. (Not long ago, I heard of an otherwise healthy man who died only six days after being diagnosed with pancreatic cancer.)
Regardless of whether Upshaw knew about his condition for days, weeks, or months, his passing creates an immediate power vacuum at the NFL Players Association. With the regular season only two weeks away, a conference call of the players will need to be arranged as soon as possible, and an interim Executive Director will need to be appointed.
Possibilities include NFLPA General Counsel Richard Berthelsen, and NFLPA outside counsel Jeffrey Kessler. Another possibility (albeit, in our view, remote) would be agent Tom Condon, who represented Upshaw and previously served as NFLPA President.
Looking ahead, it’s very possible that a permanent replacement won’t be named before the next annual meeting in March 2009. And this likely means that NFL teams should finalize plans for the “last capped year” under the Collective Bargaining Agreement, which will begin in late February or early March of 2009.
In 2006, a new CBA was negotiated on the eve of the “last capped year,” since the cap rules and restrictions were forcing teams to realize that the “last capped year” was going to be nearly as much of a headache as an uncapped year. So if the league ends up entering the “last capped year,” the chances of having an uncapped year in 2010 possibly would increase.

A friend of mine was perfectly fine one Tuesday. On Wed he went to the hospital with severe abdominal pains. He was diagnosed with pancreatic cancer. He died that Saturday night.
Only four days from seemingly perfect health to death. This stuff is nasty.
I suppose that some will view this as being a good thing for the players association. But the fact is that Upshaw helped to stabilize the sport from a business perspective. He kept things real in a world that sees the pro sports of Baseball and Basketball entering dangerous realms of money thrown at players.

if football enters an era of uncapped spending (of longer than one year), it will ruin the game and render most teams to second rate organizations (Vikings, Packers, Bengals, Jags…to name a few).
It will be baseball but with less games. The owners CAN NOT let this happen.

He got the players something like 55% of the gross. People may not like him. But it appears as if he did his job as a player and the head of the NFLPA.

Wow, that’s shocking. As much as I loathe unions in general, the NFLPA was an exception. Upshaw went to great lengths to make good deals, at least after the ridiculous 1987 strike. He helped create the best salary cap system in sports, where players can still make thier money but teams can dump them if they underperform their contracts. The rookie thing has gotten out of hand, but beyond that, it’s basically a perfect system and Upshaw played a major role in creating it. That will be his most significant legacy, IMO.
Sorry to see you go, Gene. You made a difference.

Taking into consideration that the man is not even in the ground yet….
but shame on Mr. Upshaw for fighting every attempt to put a successor in place. He clearly was letting his own ego outweigh the membership of his union.

This story is just a report confirming Mr. Upshaw’s passing and some of the possible effects from it. I don’t think it is necessarily the best place to offer condolences to his family. I would expect Florio to eventually have an editorial type piece where he could properly express his sympathies.

Now, maybe the Rookie salaries will get fixed! It’s ridiculous to pay a guy who’s never taken at snap at the NFL level starting money!
I know Gene always said that rookie salaries make up about 1% of the cap??? That could be true! I don’t know, but 30 Mil, half of it guarunteed? Come on! Only about 50% of the 1st rounders start! It’s a 50/50 proposition. Maybe Al Davis doesn’t care about the money he’s throwing around. Most owners do. Especially small market teams. If you miss on a first rounder it could set your franchise backwards a few years. Even if you cut a guy, you have the dead money issue. Dead money counts against the cap!

I’m shocked and saddened by this news.
Upshaw was one hell of a player and did a hell of a job for the players the past 20 years or so.
I have a strong feeling that people who bash him will see that things could have been allot worse, because they will be in the future.

RIP Gene Upshaw, a great Raider & Union Chief. I think Upshaw could have been a problem with upcoming negoiations. He didn’t see a problem with the rookie salary issue and maybe they can figure out what is fair for players & owners.I don’t want to see an uncapped season or another strike.Pay the players that deserve to get paid & come up with an equitable agreement so I don’t have to keep hearing about an uncapped season/strike on this website.
