When asked several weeks back whether a team could trade for quarterback Brett Favre and then re-trade Favre to a team that the Packers wanted to keep him from joining (i.e., the Vikings), we suggested that the Packers would insert in the deal a clause that skyrockets the compensation if/when such a move occurs.
Adam Schefter of NFL Network reports that, if the Jets were to trade Favre to the Vikings, the Jets would owe the Packers three first-round picks.
Though NFL spokesman Greg Aiello declined to comment on whether such terms would be approved by the league, we see no reason why the league would strike such a term. Conditional terms appear in trades on a regular basis.

Yah i thought the same thing, force retirement and say he will buy out his contract or else he will retire thus if he buys it out it he becomes a free agent. Though im sure there is tons of things in the contract that would probably prohibit this

Vikings trade 2nd round pick to the Jets (1st round if they win the superbowl) for Paul Raymond the undrafted rookie WR on the Jets roster.
The Jets simply give Favre his “release” he wants.
Favre signs with the Vikings as a F.A.
The Jets essentially give up a 4th rounder and get a 2nd rounder (maybe a 2nd and a 4th) in exchange simply for being the middleman.
The Packers think they are being smart with the THREE first round pick penalty but end up not even getting a 2nd rounder from the Jets as Favre never plays enough on the team for the draft pick to escalate.
Anything is possible if Favre really wants to be a Viking….the Vikings really want him (maybe they don’t)….and the NY Jets don’t mind never making a deal with the Packers again (everyone hates the Jets for ‘outing’ the Pats anyway)…

Does the league have to approve all trades, or just the legality of the terms of the trade?
If it’s just the latter, and if there is no clause that the Jets will have to send the Packers picks should they cut Favre, then the Vikings could simply send the Jets a first or second round choice for some backup player like Chris Baker, with a gentleman’s agreement that the Jets would “coincidentally” cut Brett Favre shortly thereafter. Favre and the Vikings could then be free to do a deal, and the only risk would be the first-mover disadvantage — since the league would never approve of a formalized agreement like this, it would have to happen on the honor system between the two teams. If there is a way each team could make their move at the same time without having to reach an agreement subject to NFL approval, that would be optimal (but I doubt it is possible).
The Jets, though, have a lot less to risk in a fourth round pick should they cut Favre first and the Vikings reneg on their offer and just sign Favre without sending the picks.

Obviously this is not going to happen, but why couldn’t the Jets release Brett Favre and then trade some schmo they are going to cut anyway to the Vikings for a first round pick? I suppose the Packers could have included a provision keeping the Jets from releasing Favre, but that seems unreasonable.

And why would the Jets let Brett “buy” his release? They still wouldn’t stand to earn any compensation for the draft pick they spent to get him in the first place; they couldn’t just make an under-the-table deal with the Vikings to cut Favre and then let the Vikings sign him quietly, because a) that wouldn’t allow the Jets to collect any compensation in terms of picks and/or players, and b) that would probably be some form of tampering or other violation.

What if Jets trade him to another team, and that team trades him to Vikings?
Jets could possibly get an upgrade in the draft for doing nothing but acting as the middle man. I doubt the contract is that simple though, Packers can’t be that dumb…or can they?

In fact, if Favre gave the Jets an ultimatum to cut him or he wouldn’t play, the Vikings actually could move first in a secure fashion and send NY a pick in the first two rounds. At that point, it is unlikely that a team with management on the hot seat like NY will put up with the ensuing season-long headache and $12 million of cap space just to move up 60 spots in the middle of the draft.
If the league approval is only necessary for the legality of trades, then I hope for the Packers’ sake they were smart enough to include language that explicitly said “If Favre is on the Vikings roster by the trade deadline, then the Jets owe us three first round selections” as opposed to “If Favre is traded to the Vikings, the Jets owe us three first round selections”. I am sure this scenario is one of several the Jets and Vikings could think of to get Favre to Minnesota with fair compensation to NY and without actually trading him.
