One of the (rare) moments during which we gained some actual credibility in league circles came in 2005, when we explained that Eagles running back Brian Westbrook risked losing his ability to become an unrestricted free agent if he didn’t report to training camp by a specific date in August of that year.
By all indications, Westbrook’s agent didn’t know. And Westbrook eventually showed up.
Though the Collective Bargaining Agreement has been revised since Westbrook’s holdout, the provision in question still applies, and Bears receiver Devin Hester is the first guy who could lose a year’s credit toward free agency because of it.
Under Article XVIII, Section 1(b) of the CBA, “a player shall not receive an Accrued Season for any League Year in which the player is under contract to a Club and in which he failed to report to such Club at least thirty days prior to the first regular season game of that season.”
Since the 2008 regular season begins on September 4, Hester (a rookie in 2006) needs to show up by the close of business on August 5. Otherwise, he’ll not accrue a third NFL season in 2008. Four seasons are necessary to become eligible for unrestricted free agency.
Under the current CBA, however, it’s a distinction without a difference. Even with four accrued seasons after 2009, Hester would still be a restricted free agent, since six seasons of service are necessary to qualify for unrestricted free agency in the uncapped year of 2010.
But if new CBA is finalized before 2010 and if the four-season requirement for unrestricted free agency remains, Hester would be a restricted free agent in 2010, because he would have only three accrued seasons.
Bottom line? Look for Hester’s holdout to last no longer than August 5. Until then, he’ll be subject to fines of more than $15,000 per day, and he might have to repay 25 percent of his signing bonus allocation applicable to the 2008 season.

Couldn’t he report to camp and then stop showing up after one practice?

You’re the man, Florio. You should’ve been a lawyer.
The Bears should let Hester report whenever he wants. It’s not like he needs to “learn” the playbook. He’s like Forest Gump
On opening day I hope he runs from the parking lot, through the tunnel, off the sideline, into the end zone, fields the opening kick, runs 99 yards, pivots and runs untouched another 100 yards in the other direction for a safety and then hands the ball to the nearest Bears fan, just to show off his skills.

First for his team or the league? That is ambiguous.

Hester, a kick returner all pro. But, the Bears didn’t make the playoffs with him. And they won’t this year either. Hester is STUPID.

Um, Scratch? You must not follow the Bears. If you did, you’d know that Devin Hester, possibly more so than anyone else on the whole team, needs to “learn” the playbook. Did you see his performance at wide receiver last year? It was like watching Pop Warner league 10 year olds learn how to play the game.
Hester on special teams is fun to watch, but what the Bears really need is for him to learn the offense so he can contribute in a way that might result in wins instead of just making the highlight reel. Hester needs to learn the playbook so I can at least doubt my current belief that the Bears have the worst receiving corps in the NFL.

DarkAge,
That was a tongue-in-cheek statement on my part. As a graduate of The U, I’m VERY familiar with Hester’s inability to run simple routes.
Maybe they can stick a TomTom inside his helmet to give him directions off the line of scrimmage.

The guy who is more valuable than anyone on the offensive roster, and coveted by the rest of the league… the only guy on the roster that opposing teams have to gameplan for… and he’s making right around $500k?!?!…
Guys, (and gals), put away your “you signed a contract” and your “these damned athletes!!” hatred and look at this realistically (especially you bears fans)… the man deserves a raise…
At this point he’s being insulted. Give him a little more money (he really does deserve it) and then give him some WR-related incentives. He wants to be paid like a (healthy) Steve Smith. But he hasn’t proven he can carry the load. Ron Turner says he’s tripling his snaps this season (3x the number of WR screens I guess). What does it hurt to say “here’s some money up front because we love you, and if you play like a #1 WR, here are some incentives that will pay you like one, if you get in the endzone more often than Berrian did (6+ times?)”
Then everyone is happy, right?
Hester playing this year at $500k, contract or not, is wrong… and they need him and he (and his agent) knows it. Pay the man!
