We’ve gotten several e-mails, and seen several comments, regarding the question of whether a player who has retired can be the subject of tampering allegations.
The easy answer is yes. Absolutely, yes.
If a player retires with years left on his contract and his team placed him on the reserve/retired list, the team still holds his rights. And, consequently, no other team may talk to the player about unretiring and playing for that team.
The difference between Brett Favre’s situation and the case of Junior Seau, who retired after playing for the Dolphins and then signed with the Patriots, is that Seau was also a free agent at the time. Favre is under contract with the Packers for two more years, and those two years will be in place indefinitely, unless and until Favre plays for the team for two more seasons — or unless and until the Packers release him.
Any other rule would invite mischief. For example, Bengals receiver Chad Johnson, who tried his damnedest to get out of Cincinnati, could have “retired” in the offseason, and then signed with the Redskins or any other team as a free agent in August.
Meanwhile, I’ve reviewed Jay Glazer’s report regarding the tampering allegations made by the Packers against the Vikings and Josh Alper’s PFT blurb regarding the same, and an obvious question arose.
How in the hell did the Packers know that Darrell Bevell and Favre were engaged in “inappropriate dialogue”?
Unless the Packers are simply relying upon the rumor mill, we see two possible explanations. Either Bevell ran his mouth about the conversations to someone outside the organization who blabbed, or someone inside the Vikings’ organization blew the whistle. Regardless, it’ll be interesting to see what if any hard evidence the Packers have to support their contention.

I was hoping for a peaceful resolution to the whole Favre saga. I am a Vikings fan, on Sunday’s I loathe the packers. But I have always been a Favre fan, the approach that he took to the game. No matter how sore he was, no matter how many times he was treated like a human piñata he was in the game. You have to admire someone who sticks with something when most others would throw up a white flag and quit. But now more than ever Favre should stick up for himself and his friends. The Packers are attacking Brett and trying a smear campaign against the Vikings. Go Brett file your reinstatement papers. Show up to camp, they will not want you there, but you owe it to yourself to make things right. They will have to start you or pay you an ungodly sum to sit on the bench, or they might have to cut you. You have a 66.66% chance of getting the desired results that you want. And even if things don’t turn out the way you would like them to, you will still have $12,000,000.00 more in the bank then you did when you started the year. I think the best thing you could do for Darrell is take up precious cap room and prevent the Packers from signing key free agents. Oh wait, that’s right Green Bay has no desire to sign free agents.

But why does the following work: Vested veteran, unhappy with your contract and wanna skip camp, but don’t want to be fined?
Retire just before camp starts and unretire when camp is over. No more fines!

A few points. Someone asked if there was any bonus money left on the final 2 years of the Favre contract. I am 99% sure the answer to that is ‘no’.
We know that the team made the allegation last week from the Fox report. My suspicion is also that the source for the Packers’ claim is Favre himself. I reckon that Favre blurted out that Bevell had stated that the Vikings would be interested in him in the infamous conference call he had with McCarthy and Thompson on 8th July. If that’s the case, and Favre confirms this when the league investigates, then the Vikings could be in trouble.
Tampering is hard to prove, but a big part of that is that normally the player involved keeps his mouth shut – because clearly they don’t want to compromise relations with a potential new team paying them a lot of money. But if Favre has already flapped to the Packers, then he’s either going to have to sing the same tune to the league or admit that he was lying to the Packers. If he does the latter, then it’s going to undermine his leverage – bear in mind he has accused the Packers of telling half truths to him and to the public in the Fox interview.
Given the current acrimony between Favre and the Packers, if Favre confirms the team’s allegation that might be enough evidence for the league to act against the Vikings. If my hypothesis that the source for this is Favre himself is correct, then I think it’s quite a shrewd move by the Packers either way.
The Milwaukee J-S is reporting that the Packers have provided the league with evidence and information, and that they believe the case against the Vikings is strong.
As for Bevell, if he’s discussed Favre playing for the Vikings, then it was foolish (albeit that he would be somewhat unlucky to get caught). Sure, everyone has buddies on other teams, but you can’t discuss stuff like this. Even if Favre brought it up, Bevell should have refused to discuss the matter. Really, it’s a matter of professionalism.

You know what, this is just another attempt by the GB front office to smear Brett Favre. They already know they are NOT going to release him via cutting him and they already know they are NOT going to trade him to the Vikings or Bears. So why file the tampering charges, especially if they dont have hardcore evidence? A ploy by TT to make Favre look like hes trying to go to the Vikings and crush little Packer hearts. ITs crap

As far as Brett filing retirement papers, it doesn’t matter.
The Packers placed him on the reserve/retired list. That makes him retired. This happened just a bit before the draft iirc, which seems like it coincides with the canceled trip the last time he was unretiring, then staying retired.

Brett’s contract was setup to lessen a cap-hit whenever he may retire — The bonus money is only around 1.4million for these last 2 years. The contract still has 2 years 25 million left on it.
The Player no longer has to file retirement paperwork, you only have to claim you have retired. The Packers put Favre on the Reserve/Retired list on April 25th. 2 months after his retirement press conference he held in early March where he clearly said he was retiring. Brett is now forced to ask the NFL Commish to be re-instated.

yes favre stepped in it. he talked tough especially on tv trying to get out in front of the pack in the public eye, with some pure bs.
instead, t2 called his bluff. tampering. by a so-called hall of famer.
wanna bet the pakc have taken better notes thru all this? they own the rights to fave playing for 2 years. bf’s echo chamber can cry for him to be released all they want. a better idea would be to tell bf he has been a dumbass himself. lets see what team’s signal caller goes down in camp/preseason, because that is where he would likely go.
in bf’s mind, do any rules apply to this prima donna?
he said he retired. even if the packers ended that fone call immediately by saying “ok thanks bye click”, he retired. they moved on. now he is perturbating them just because he can and because his echo chamber wants another payday. there is no child out there like a 40 year old child, folks.

Of course, it was probably Favre who thought he was using some leverage on Thompson by saying “If you don’t want me, just give me my release, ’cause the Vikings told me they’d want me”. He should just stay hiding behind his Mother’s skirt and let let her and his brother do his talking for him. When he talks, he manages to send his friend Bevell and his former center Campen down the river, and he burns his bridges by calling his Head Coach and GM liars. Brett, that “itch” you feel is down your backside - stay home and scratch it.

Players who do this generally sign a one day contract to retire with their old team. So, Junior was most likely not under contract when he had any discussions with the Pats.

favre cleary said that thompson lied saying favre never tried to gety the cheapskates to sign randy moss. so lying is not beyond them.
i remember last year the falcons and espn all defending michael vick and pushing issue aside. i dont believe anything any suit and tie working for a big business says.

If, as some other posters are suggesting, this was a “pre-emptive strike” or a tactic designed to scare the Vikes away, ala the Lance Briggs/S.F. situation, would the cheese then be subject to disciplianary action?
It would seem to me that division rivals can’t just accuse one another of tampering whenever they see fit…

bob, the pack apparently owns the cellfone bf has been using to make calls to the VIKINGS. unless he is “double agent 004″ intent on taking down doofus brad childress et al, then he just may have handed roger more incriminating info than he had on the niners/briggs tampering situation.
lets see the transcripts and that will determine if it was reasonable to say the vikes tampered. i am inclined to suggest that the pack gave bf a lot of leeway hoping something mutually agreeable could be worked out. and that they finally had their fill.
if it was all friendly fone calls, i would agree that the pack should get their hand slapped instead, but i didnt see that happen to the pats or the bears.
someone sure has a bias against “suits”. some unresolved anger, eh?
bf has flip flopped a bunch since the end of the last season. t2 is keeping quiet and for all i know he is king a-hole. but at what point does the verbal diarrhea of bf get analyzed for what it is…
