NFL spokesman Greg Aiello tells us that the eligibility of receiver Chris Henry to re-join the league is “under review.”
Earlier on Monday, charges against Henry were dropped, just as a second trial on the matter was about to get started. Henry had been indefinitely suspended pending the outcome of the case.
Per WLWT-TV, the decision to dismiss the case came after the judge refused to exclude from the trial the following pieces of evidence: (1) charges against the alleged victim being reduced; (2) a request from the alleged victim’s lawyer for a settlement; and (3) testimony about the violent character of the alleged victim.
Henry had been accused of punching a University of Cincinnati student earlier in the year. The Bengals cut Henry in the wake of the arrest.

While Chris Henry is a turd, those last two pieces of evidence definitely goes to show that this wasn’t just an open and shut case.

I still think he is going to be suspended for 8 games or the entire season. I don’t think him coming to new orleans will be such a good idea. Now he would be a great fit at wide out, because we really need another one, but there is way to many temptations down here for him not to get in trouble. But who knows, maybe he turned his life around……(don’t count on it).

This was a classic case of the complainant of trying to “negotiate a settlement” (i.e. extortion), prior to filing. Although settlements, whether executed or not, are not admissible in a criminal trial, the prosecutor, for some odd reason, didn’t object. The defense called Henry’s personal lawyer to testify about the offer from the complainant. Since the trial ended with a hung jury (10-2 for acquittal) the prosecutors decided to drop the charges rather than continue this nonsensical trial.
For those of you that think he was provoked, you’re sorely mistaken. There were witnesses, but the $100,000 demand didn’t sit to well with the jury.
