TMZ.com is reporting that some Eagles are being brought into a lawsuit between a woman whose daughter is disabled and a New Jersey restaurant accused of not providing adequate parking for people with disabilities.
The lawsuit, which accuses the Landmark Americana Tap and Grill of violating the Americans with Disabilities Act, says that “[o]ne notorious incident involves Philadelphia Eagles football players Donovan McNabb and Jevon Kearse using reserved spaces at Defendant’s business premises.”
TMZ reports that former Eagles linebacker Jeremiah Trotter is also named in the suit as someone who parked in reserved spots. And TMZ says McNabb was fined by a judge in 2006 because his vehicle parked in the Landmark’s handicapped spots, although McNabb wasn’t driving.
NFL players often need crutches after leg injuries; it is not clear from TMZ’s report whether McNabb, Kearse, or Trotter
were on crutches at the times they’re accused of parking in handicapped spaces.

McNabb was fined by a judge back in 2006 for parking in the Landmark’s handicapped spots. McNabb wasn’t actually driving the car that got the ticket, but was fined because he’s the owner.

This is OOOOOLD news. I remember hearing about this on the local news in Philly almost two years ago, and from what I remember, neither were on crutches at the time ( that was the week when McNabb was actually at full health!)I guess the lawsuit is just beginning to get attention in court. McNabb and Kearse will probably lose this one.

Whether he was on crutches or not at the time of the incident is irregardless. Handicapped parking is for those who have the appropriate designation, either handicapped license plates or hanging placard. The requirements to obtain the credentials is a bit more involved than just hobbling on crutches. If not, then any slob could feign a limp with a cane while ambling into the local Wal-Mart just so they could avoid taking the extra 20 steps from a legitimate parking space. Donnie Mac is guilty of thinking the rules of society doesn’t apply to him.

Good for this mom and her child. These athletes… I cannot believe them. “Oh, my leg is hurt!” “Oh, I got hit hard in the back!” Holy crap, this is what you are paid to do!
Some people and children are born with natural disabilities and they go through their lives fighting insurance companies, SSI, the government in general and numerous other battles just to get by in life. One of the good things done was to have parking places for these fine people just to make life a little easier.
Now we have millionaires who could pay someone to carry them into a restaurant or where ever taking up these spaces without a handicap license. Do they know you have to have a Dr’s prescription and the BMV’s issuance of this parking permit? The law is the law and maybe the counter should get reset for this too?
In case any one wonders, this comes from a dad who has an 11 year old daughter that has been blessed to use a wheelchair to get around in due to being paralyzed from the waiste down from birth. Many times we pass up the handicap spots (which we have a permit for) because of the many elderly people who can barely walk that need it more. I guess it comes down to judgement skills and overall decency of how you see and live your life. I am glad I don’t make $10 million a year, I suppose I would think I ruled the world too.

I guess it’s possible that the law could be different in Philly but most everywhere else more is needed than just the use of crutches. Using crutches does not make you handicapped. You’re supposed to have either the permanent license plate or the temporary that everyone just copies anyway and hang it on your mirror.
I have three disks in a row (L4-L5-S1) that are all bone-on-bone. I qualify to have the permit but I would feel like an a-h0le if I got it just so I could park 10 feet closer to the door.
I have no sympathy for anyone who uses the reserved spaces and doesn’t need them. Show a little class for once, McNabb (and friends).

I’m an Eagles fan, but c’mon man, I’m sure they weren’t parked there because they were injured or on crutches. It was more like the all to common “I’m a star, so I park where I wanna” motto. Or perhaps it was done as a precaution to ensure there rims would be safe until there return, either way it’s wrong! If they go there so often, maybe they should ask the owners to designate other closer parks for them, not the handicap parks fellas.

Just so everyone knows, this happened years ago, and neither McNabb nor Troetter were driving their cars, McNabb wasn’t even in the city of Philadelphia when this happened. I can’t say for sure about the specifics of Trotter and Kearse, but yeah, this is the same story from a few years ago. It’s really not a big deal anymore. I’m not saying the lawsuit shouldn’t exist, just that this should no longer be a story.

I’ll say it: I’m a crappy parker. I always park in the “To Go Only” spaces at Pluckers and ain’t scared to park right in front of a building I know I just need to run in and out of. That said, I would never… EVER… park in a handicapped space! Pride and common decency prohibit me from even entertaining the idea, no matter how full the parking lot is. I’m disgusted by this story and hope Kolb does really well when playing for the injured McNabb…

Sorry but I go a different route on this one. SCREW them! Just because they are handicapped makes them special?? Hell most of em don’t even have to walk…they should park FURTHER out! I’m sick of going places and seeing 30 handicap spots and I gotta park in BFE while some schmuck old guy get a sticker and gets out of his car in his golf shoes. The handicapped parking system is a joke.

What is this? National Sound like a Douchebag Day? Half of you ass’s should have your eye plucked out for not reading or having half a f*cking clue what your talking about. The lawsuit is between the mother and The Landmark Americana. This has nothing to do with any NFL players. This woman has a history of going around and enforcing establishments to unhold handicapped parking spaces. She’s constantly in court. She’s been in her share of trouble with the law too. It states she has a handicapped mother and daughter….However I don’t necessarily believe she’s all that sane either. Look her up…. Maryann Cottrell. Maybe her daughter would be better off with her mother’s undivided attention instead of this psycho constantly fighting the justice system.
