More than two weeks before his infamous McDonald’s bag mishap, Broncos receiver Brandon Marshall was arrested for misdemeanor domestic battery.

The news comes from the Denver Post, which also reports that the NFL is aware of the situation and looking into it.

Marshall’s girlfriend, Rasheedah Whatley, filed a complaint in Fulton County, Georgia against Marshall on March 5, claiming that Marshall struck her in the mouth and left eye.  The criminal complaint says that Whatley had ”visible marks above the eye and a laceration on her top and bottom lip.”

Obviously, the matter could subject Marshall to punishment under the Personal Conduct Policy.  The bigger problem for Marshall could be his failure to promptly report the arrest to the team or to the league.  Though the team said on Tuesday that it and the league know about the situation, the question becomes when were they first made aware? 

If Marshall didn’t promptly disclose the arrest, the punishment could come more swiftly, and it could be more severe.  Especially in light of his history of arrests.  (In this regard, consider the case of Adam Jones, whose full-season suspension in 2007 was fueled in part by his failure to report two 2006 arrests, both of which also occurred in Georgia.) 

The news of the March 6 arrest now makes us wonder whether the March 22 mishap, which began as a slip-and-fall on a McDonald’s bag and then evolved into a wrestling match between Marshall and his brother, makes us wonder whether the grappling was real — and whether Marshall feared at the time that his brother might press charges of some sort against him.

Meanwhile, Marshall is represented by attorney Harvey Steinberg, who apparently has opened an office in the team’s facility.  Steinberg has represented over the past year former Broncos running back Travis Henry, coach Mike Shanahan, former Broncos punter Todd Sauerbrun, and now Marshall.

Finally, the fact that the news of the arrest was covered up for more than a week require a re-setting of the “Days Without An Arrest” meter to “00″.
