Bears running back Cedric Benson, whose job is in jeopardy after he was arrested for drunk driving, claims that he aced the field sobriety test after a police officer pulled him over in Austin, Texas.
The Chicago TV station WMAQ reported Sunday night that Benson sent a text message to one of its reporters saying, “I aced the field test, check the video.”
So far no video of the incident has been released, but an Austin police spokeswoman offered a different version of events, saying Benson was arrested as a result of poor performance in the field sobriety test. Benson refused a Breathalyzer and would not provide a blood sample.
Benson’s lawyer says that Benson wasn’t drunk but did consume two or three drinks. Benson is expected to participate in the Bears’ organized team activities today.

1. hire a driver or take a cab if you are gonna be out drinking should be pretty easy you have alot at stake.
2. stay the hell outta Texas go back and stay in Chicago
3. stop drinkin period cause it’s about to cost you your career

2 or 3 drinks puts most people over the legal limit, drunk or not.
And if he aced the feild test, why refuse the blood and breath test. Everyone knows refusing those means you are going to be arrested.

The saddest part of all of this is that drunk driving arrest are looked at by athletes as ok, if you don’t get caught. The point with Benson is with lawyering up he may never get convicted. He won’t take it seriously, and him or someone like him will only learn their lesson when they kill someone else. So sad that people like Benson truly believe they area above the law and should not be held accountable for things that common people should be held accountable for.

I have a tip for Mr. Benson. If you are trying to prove to people that you were framed for operating a boat while intoxicated, you should probably avoid getting a DUI while trying to prove you’re innocent. Just a thought.

Replace “was arrested” with “failed miserably to perform up to expectations this past season” and you could have ended this sentence without the words “sobriety test”.

I wonder how many people ace their test, I thought I aced mine, turns out the I didn’t. If everyone arrested for DWI only had 2-3 drinks like they said, the liquor business would be awful.

I hope and pray , literally, that by noon today this overpaid total bust is an ex-Bear and on a flight back to Austin. We must suck it up, bite the financial bullet, and move into 2008 with Forte, Peterson, and Anderson.

So I just got busted for OUI about a month ago, which I am trying to prove that I wasn’t intoxicated. In the mean time, I think I’ll go have a few drinks and then drive home… Wow… What did this guy get on his Wonderlic? A 2?

This is a great post and summarizes it perfectly. Over the legal limit is over the legal limit, even though im sure a big guy like Benson could handle more than 3 beers. Its still against the law and seeing how hes in enough trouble over this stuff, he should have taken a blood test to show he was definitely not drunk. This guy needs to be released

no, 2 or 3 drinks won’t put a muscular 220lb athlete over the legal limit. that was made in a statement released by his lawyer so it can’t really be taken seriously though.
if you know you can’t pass a Breathalyzer test, refusing to take it is usually a good choice.

I am a police officer in WI, and I can’t tell you how many people truly believe that they “ace” their field sobriety tests. Infact, nearly everyone I have given tests to, really believe that they did just fine. What a lot of people don’t realize is that the officers are not ONLY looking at balance, but the ability to follow instructions is a major factor. Also, about 95% say they only had 2-3 drinks (mmm hmm). Laws are different in every state, but I have to believe that they are similar in DWI cases, in that if they get to the point of requesting a blood or breath test (breath test is NOT the PBT you blow into on the street, there is a much more accurate one like an intoximeter, which is admissable in court) that they have enough evidence to arrest based on driving and the feild sobriety tests, already. By refusing testing at this point, it can be used against you in court, and there are further penalties. Nothing a high price attorney CedBed can afford shouldn’t be able to get him out of.
Being a Packers fan, I usually love to see the Bears go through difficulties, but I can’t help but feel bad for their fans to have to put up with this POS, especially after getting rid of Tank.

So let me get this straigh…when you were busted last month for boating under the influence, you weren’t drunk or resisting arrest…the police just over reacted. This time you just refused to take a blood or breath test but passed a field test which the police say you failed. Would anyone be suprised if it turns out that Benson’s poor preformance last season really wasn’t him… it was just the police saying he stinks.

Yep, it’s called horizontal gaze nystagmus, one of the tests give during feild sobriety. Nystagmus is just a fancy word for involuntary eye movement. It’s a great test that has nothing to do with balance. It is very useful for “seasoned” drunks, that may be able to walk and talk normally because of their alcohol tollerance. Your tollerance has no effect on this test. It’s fun to try with your drunk friends. Have them hold their head still and follow your finger only with their eyes. Now move your finger way out to the sides so their eyes are as far left or right as they go. Now you’ll see their eyes twitch back and forth. The more intoxicated, the more you can see it.

What I don’t understand is why a guy who realizes his career is in jeapordy even chances driving after having a few drinks. Most people like us who will never make this kind of money don’t do it simply because we have alot to lose. In his situation, he has even more to lose because of the money involved and the fact that he probbaly would not know what to do with his life if he wasn’t playing football. You hate to see anyone throw their lives away. but what i hate even more is putting someone elses life in jeapordy by driving after your over the limit (see Leanord Little). With all that money just hire a driver to take you around

Refusing the breathalyzer is enough to book a person for drunk driving. They taught me that in drivers ed 28 years ago.

I actually am pretty good friends with one of the arresting officers. Benson didn’t “ace” anything. The guy was clearly drunk to the officers. I mean, they were actually Longhorn fans and knew who they were dealing with, but they take their jobs seriously (unlike a lot of cops in college towns).
This is just another example of a guy who doesn’t get it. He never did. He got into plenty of trouble here in Austin before the Bears drafted him.
