The arrest of Bears running back Cedric Benson has developed into one of more gripping legal dramas that the NFL has seen since Mark Chmura decided to cavort with high-school girls.
Police claim that Benson was operating his boat while under the influence and that Benson thereafter resisted arrest. Benson claims that he wasn’t drunk and that he was mistreated by police, a contention that has been corroborated by one of the women who were on his boat.
Benson is now finding support from a woman who had no connection to his boat. Toby Patch claims that he saw police “manhandling” Benson after they took him off the boat.
“As they were taking him up the dock, they stopped. He said, ‘I am fine, I can continue walking,’ and they put their legs behind his knees and knocked him over his knees and started hog-carrying him,” Patch told KXAN in Texas, via the Chicago Tribune.
“They ended up — I don’t know why — but laid him on his back, I head him say, ‘Please don’t pepper spray me, please don’t pepper spray me.’ It was uncalled for, it was ludicrous, no point for it.”
Meanwhile, the Tribune has the Benson booking video, which really doesn’t show much of anything.
Benson reportedly is considering a lawsuit, and we think that he should go for it, since it’s the best way to get to the truth as to what happened on that boat.

I have seen so much police brutality and corruption in my life that I automatically believe anyone who says they were treated poorly no matter how outlandish their claims are. I went to Umass Amherst from 2001-2005 when the school developed a reputation for uncontrolled student riots. I was present for each and every one of the so called riots. The school has a huge student population and it was common for parties to gather thousands of students. The parties never became “riots” until the Umass and Amherst police officers showed up. Their method of breaking up these huge parties consisted of opening fire with pepperball guns and wild swinging of police batons. I personally witnessed my friend fall down as we tried to run from the pepperball fire, as he lay on the ground three officers came up and started kicking him as he lay on the ground. Completely unprovoked and I regret to this day that we didn’t have a videocamera with us. On the corruption side of things it was common for police to search drunk students for drugs without probable cause and then pressure them to become informants if drugs were found. Maybe there are good cops out there but I have yet to come across one. They do what they want because they know most students don’t want to tell their parents about getting arrested and can’t afford lawyers to fight the charges.

Wht I find funny is I am 33 and have never been profiled, wrongly accused, or harassed by police. I guess I dont call it harassment because I was doing something that I should nt have been doing. Correct me if I am wrong, but I though Cedric THE NON ENTERTAINER Benson refused to leave his boat? If he did that that is resisting arrest!

I have witnessed a lot regarding Police overstepping their duties and using the pretense that there safety was in question. One night in Miami, after an ice hockey game we went out for a few drinks. One of the players, a Miami Police officer was drunk and was talking about why he moved from the Northeast to become an officer in Miami? He said with a slurred speech, “because of the riots, he loves to put on his leather gloves, take out his billy club and pummel the brothers in the inner city when they act up!” I’m like ‘hey dude’ easy man… You can’t go out there and break guys skulls cause you don’t like them? Then I realized in many cases the Police officers of today are the same guys who were considered bullies in school… You know who they were and they pull the same routines just behind the badge… When they do a heinous act… The policemen’s union usually gets them off…! I to this day am very wary about the nation’s police. I officate sports and in the adult leagues whether its softball, baseball, basketball… These guys come to the field or arena with a chip on their shoulder and are ready to take on all comers…? What’s that all about? Just how stressed out are some of these guys? Infidelity, gambling, alcohol abuse, spousal abuse… Ad nauseum, the cops are up there with the NFL Turd watch too… Just my take…

Yeah, no kidding. I said what WAS HIS BAC level, not what IS a BAC level. If a player gets busted for DUI (DUI = Driving Under Influence) his BAC is usually reported quite quickly. I have not read what his BAC level was and he was arrested for operating his boat while under the influence.
So what was it? If he was truly under the influence, then report what it was and get it over with and this story will go away. Until then, I’m going with Benson is innocent until he’s proven guilty.

no matter how you look at this, it’s becoming a drama. Either way the cops are getting a black mark on this one. When outside parties are stepping in and saying ‘the cops were wrong’ something is up.
I didn’t believe the first report with his buddy on the boat coming forward and stating he called his/her parents stating ‘my black friend is being abused by the cops’, but now it’s starting to have a ring of truth. One thing here is that boat owners stick together/ look out for one another. I’m not surprised other people saw what was taking place. If they hog tied his butt, there is no reason for it and the cops will be yanked from the force.

Here’s what I don’t get:
“I called my dad and told him, ‘Call 911, my black friend is getting beaten up by police on Lake Travis” - quote from Elizabeth Cartwright, a friend of Benson’s who was on the boat.
Please excuse the upper case but WHO THE HELL CALLS ANOTHER PERSON TO TELL THAT OTHER PERSON TO CALL 911?!?

Instead of carying guns around, maybe pro-atheletes should have their hangers-on carying around video cameras. I work in law-enforcement and have only the highest regard for police officers. They need to keep themselves safe and sometimes force is absolutely necessary…
However, I’m wondering what really went down as Ced-Ben got arrested and how cooperative/uncooperative he was. Pepper spray shouldn’t be used unless violence appears imminent, and if the situation is as Ced-Ben’s friends are claiming then there are some definite issues to explore.
The one question I have is whether or not he was offered a Preliminary Breath Test (required in Virginia at a DWI arrest, don’t know about Texas) and whether or not he refused to take the Intoxilizer at booking. If someone in the media (Smoking Gun) could get their hands on the criminal complaint and/or the breath test results it might shed some light on things.
In any case, he’s not a very good NFL runningback.

I hope Benson is innocent. Not because I like the guy (I just don’t think he’s a passionate player) but because I would:
1 - Like to see a high profile black person nail the police for racial profiling. My friend and I got pulled over a few days ago by Boston police because my friend is black…I have never really experienced racial profiling until then…it is ridiculous and is just infuriating.
2 - As much as I like the idea of the “Turd Watch”, it has become an obsession on this site in a bad, bad way. Although he didn’t come right out and say it, Florio was, until more information came out, doing what he could to paint the picture that Benson is a menace…much like he does with other arrested players. It is only a matter of time before Florio rips an innocent player and damages their reputation.
Innocent until proven guilty, right Mr. Lawyer?

Legally, Benson could only be arrested if the officers had probable cause. Benson can legally refuse to take field-sobriety tests and can legally refuse to speak to the officers, thus possibly preventing them from establishing their probable cause to arrest. If the officers can’t show probable cause ABSENT Benson’s refusals then they can’t arrest him, and likewise, he can’t resist the arrest. So the question is, what is the boating behavior? Does that show probability of intoxication? Did Benson admit to drinking some alcoholic beverages? Did he have bloodshot/glassy eyes, slurred speech, lack of balance, an odor of alcohol about him? The officers need to be able to articulate probable cause (is it more probable than not that Benson was Boating While Intoxicated) in order to arrest him.
Therefore the police report/criminal complaint better articulate enough probable cause for arrest or the police were in the wrong and Benson’s rights were violated.

Obviously he was not drunk or they would have released the BAC. Maybe the River authority was having a bad day. (Someone brought bagels instead of donuts. Those inconsiderate bastards)
I 100% support the police. Unless they are arresting former and current Longhorns. So I say sue their balls off and press charges for brutality.

what difference does it make if he refused to leave his boat? The cops may or may not have been out of line, but at this point is sure sounds like they have lied about what really happened. Then as they were getting caught they give us a lame ass press release. Why wasn’t that their initial statement? Cops get away with whatever they want all the time, if you haven’t been on the wrong end of it consider yourself lucky.

1. You are basing your conclusion on the fact that you, yourself, have never been mistreated by police. Therefore, it’s not possible for others to have a run in with some corrupt/ rule crazy outback nazi law enforcement officer?
2. Without knowing the full circumstances, to say that Benson (apparently due to the fact that his career has been less than successful with the bears) was in the wrong here is simply absurd, especially when two people have come forward thus far and corroborated Benson’s story.
