Bears running back Cedric Benson, who says he was mistreated by officers who pepper sprayed him during a weekend boating excursion, has hired a new lawyer as he prepares to fight charges of boating while intoxicated and resisting arrest, the Austin American-Statesman is reporting.
“I do not believe from what I’ve been told that Cedric was intoxicated,” lawyer Sam Bassett said. “I do not believe he was aggressive toward an officer to warrant being pepper sprayed.”
Meanwhile, the paper reports that former Texas linebacker Aaron Harris also was on Benson’s boat, and that Harris said he took pictures of Benson while he was undergoing a field sobriety test and being arrested, pictures that he plans to give to Benson’s lawyer.
Harris is the fiancé of Elizabeth Cartwright, another passenger on the boat, who told the Chicago Tribune that Benson wasn’t drunk and was mistreated by police.
On the night in question, Cartwright says she called her father and told him “to call 911 and tell them my black friend is getting beat up by cops,” possibly suggesting that Cartwright believed the police targeted Benson because he is black. The Lower Colorado River Authority, which made the arrest, says that in the last five years, its officers have made 457 arrests on the lake, and that 428 of the people arrested were white and 10 were black.
The American-Statesman reports that Bassett will represent Benson in a preliminary hearing on May 19 in front of a Travis County administrative judge.

Or that every black person they “investigate” on the lake ends up they weren’t doing anything illegal, therefore no arrest was required. They also left off the statistic of how many of those white people arrested were pepper sprayed.

Corydangerous is spot on. Until there is a demographic of how many people (and what their ethnicity is) used the lake, those numbers don’t paint an accurate picture.

You notice the first two comments, and now mine, all focus on the meaningless stat that you threw out there. If they stopped and questioned 5000 white boaters and only 50 black boaters then that gives whole new meaning to your stat. Call it racist or whatever, but c’mon, how many brothas do you really think are boating often in Austin, a city with very few blacks especially if you take away the student population.
What if Benson is telling the truth? What if these hydra-cops are racist? Imagine that? A black NFL athlete, being honest! POLICE in TEXAS being racially biased!
I can’t believe this girl would actually take the time to call her father to call 911 on the cops and that people would take pictures knowing that Benson was wrong and that those nice officers were simply doing there job! The nerve of some people!

Using pepper spray on Benson is sort of like hunting doves with a bazooka. Based upon his complete lack of toughness (and talent) I am skeptical that he would have the courage to resist arrest or anything else for that matter.

The numbers posted could be very misleading as the first poster pointed out. The numbers are meaningless out side of the demographics of the people using the lake, which aren’t provided. They don’t say how many of each type were stopped, but only given a warning, either.

The cops used excessive force on a Black guy surrounded by white women, big surprise.
Benson can’t run more than 3.5 yards at a time, so the police HAD to hog-tie him and carry him to the car.
He is a complete bust as a Pro RB, but he is still a man and needs to be treated with respect.
