		<description>LuvThatDirtyWatah, As a Pats fan myself, I think the question of whether or not these tapes are freelance or not is inconsequential. In the court of public opinion, if these tapes exist they will be linked to Belichick regardlessly (however fair or unfair that might be). Spygate, in my opinion, is been a large stir over just about nothing. As an information technology major, I can safely tell you that Belichick's camerman could've been in the crowd, on top of the stadium, in a blimp getting the same footage, OR he could have been standing on the sidelines with a camera so small as to be untraceable. He wasn't, he was standing on the sidelines. This really only proves one thing to me - The Patriots are BAD at cheating, not that the rest of the league doesn't cheat and you can bet they do (oops did I state the obvious???). If these Rams walkthroughs exist, I think we need to first evaluate what the Rams were doing that day.
I've read reports that it was a red zone offensive walk through. In that case, the Rams scored on EVERY SINGLE red zone attempt. But regardless, I must admit, it opens up a can of worms - it's better for the league that this tape not exist.</description>

How can they establish the video tapes, if they exist, are in fact property of the Pats even if circumstantial audio tapes exist? 

How can they not be proven to be Walsh's property obtained on his "own time"? 

I think Walsh and his lawyers are in for a beat-down even if it's a PR beat-down.
