Per the web site of the Hamilton County Sheriff’s Office, Bengals receiver Chris Henry was taken into custody early Thursday morning on charges of assault.  Apparently, he is still in custody.

Though Henry reportedly claims that it was a case of mistaken identity, it’s unclear whether Commissioner Roger Goodell is going to buy it.

Indeed, this could be the last straw for Henry; he could be ejected from the league.

Also, to the extent that Henry is still on probation for any of his prior legal entanglements, he could be thrown in jail based on a lesser standard of proof.  Though the well-known “beyond a reasonable doubt” applies to criminal cases generally, the burden for civil cases (i.e., preponderance of the evidence) applies when determining whether a person on probation got into further trouble.
