The tampering floodgates could be opening.
On the same day that the NFL nailed the Niners for talking to Bears linebacker Lance Briggs without formal authorization while the two teams were talking about a possible trade of the Pro Bowler, Kansas City Chiefs coach Herm Edwards bemoaned the fact that his team’s effort to sign a couple of coveted free agents was hampered by the fact that other teams apparently had an improper head start.
Regarding the Chiefs’ inability to acquire guys like center Jeff Faine (who signed with the Bucs on the first day of free agency) and kicker Josh Brown (who landed quickly with the Rams), Edwards said, “There were probably some deals done before [the launch of free agency]. We didn’t cheat. We abided by the rules. That’s how you’re supposed to do it, and that’s what we did.”
Implicit in Edwards’ remarks is that the Bucs and Rams did cheat.
And though the tampering rules as currently drafted prevent the league from taking action absent a complaint from the team to whom the tampered-with player belonged, Edwards’ remarks prove that there really isn’t only one victim when tampering occurs. In the cases of Faine and Brown, the Chiefs (and possibly other teams) lost out when they didn’t get a fair shot at pursuing the players.
Of course, the Chiefs were victims under this formula only if they were one of the rare teams (if there even are any) who refuse to engage in the pre-free agency discussions that allow agents to outline the contours of the market. Indeed, Faine wouldn’t have signed with the Bucs on day one and Brown wouldn’t inked with the Rams if either player’s agent thought that more money would be available elsewhere. The fact that deals can be signed so quickly with one team means that discussions with multiple teams preceded the finalization of the contracts.
The irony of Edwards’ remarks is that his leap from the Jets to the Chiefs a couple of years ago occurred under circumstances that could cause a reasonable person to believe that discussions were occurring between Edwards and Chiefs G.M. Carl Peterson while Edwards was still the property of the Jets. So it’s possible that the Chiefs’ chief is speaking with forked tongue when it comes to whether or not they cheated. The truth could be that they simply didn’t cheat as effectively as the Bucs and Rams did.
And that’s the point we keep coming back to. They all cheat. They all tamper. Everyone wants to get an edge, because the NFL is the ultimate zero-sum game in which for every winning team there necessarily is a losing team, and the folks who work in the football operations of the losing teams are in jeopardy of losing their jobs.
So if the NFL is going to hammer the Niners for making two phone calls of unknown content to an agent who represents a lot more players than Lance Briggs and if that standard is going to be applied to every other team, then every other team should lose one or more draft picks.
The other possibility is that the 49ers were sacrificed by the league in order to demonstrate to folks like Senator Arlen Specter (R-Pa.) that the NFL is willing and able to enforce its rules. But if those rules aren’t going to be enforced fairly and equally, it would be better not to enforce them.
Under such circumstances, it would be even better to not have rules at all.

Isn’t there a simple solution for this whole mess? If free agency “starts” on the first day of March every year, add a provision that no players can be signed for 48 to 72 hours AFTER the “start” of free agency. This would allow all teams an even chance at contacting any and all players/agents that a team is interested in.

Then after a week you can sign.

Herm, play to win the game. It’s not tampering if they didn’t sign with you for other reasons, such as you not paying as much as the other teams.

Every team cheats. So, how bout Roger Goodell penalizes every team by taking away their first round draft pick. First selection will be made in the 2nd round and (hey!) no ginormous contract for the first overall pick who has yet to take a snap as a professional!

Even if the NFL allowed a grace period to allow teams, players and agents to negotiate, there are still going to be teams who will push the envelope and do/try something that is outside the set parameters. Plus, without the ability to actually sign a contract during this negotiation time, all that has effectively been done is put players in an auction situation where the bidding will get out of hand by teams desperate to sign someone or anyone.
IMO, the best the NFL can do is closely monitor the time before FA starts, look in between the lines for quotes from agents/GM’s/coaches/players that seem to violate the terms of FA and take action.
The only other solution would be to go to a NBA-type of salary cap situation where teams are allowed to tender a FA at a max. contract and the player is allowed to choose between teams, given that the money will be the same.

Carl Peterson has no morals whatsoever. He is just as calculating and manipulative as the next guy, so for Herm to suggest that the Chiefs missed out on Faine and Brown because they played by the rules is absolutely ridiculous.
The league really has no reason to intervene as long as the gravy train keeps running.

I don’t believe every team cheats when it comes to signing free agents. I’m sure there are other teams out there, but can someone please tell me the last player the Steelers signed minutes after free agency opened? Or even the first day of free agency for that matter.

I want that 1st rounder back too! Heres an idea for Roger:
take away every team’s 7th round pick as punishment, so that there can be increased fighting over undrafted players, and thus more tampering. Then next year, he can do the same, but take a 6th and 7th, doubling the problem … and in 7 years, there won’t be a draft… and Goodell’s bio will be written:

Florio - you say everyone cheats when it comes to F.A. I disagree, there is No way that G.B. can be lumped into that argument since Ted Thompson came aboard. I think he has signed 3 F.A. in 3 years and they all were long after the start of the signing period!

That’s a great point by Florio. It IS important to enforce rules, but if they are not enforced fairly — if one team is used as the sacrificial lamb — then why enforce rules at all? Or, at least these set of rules.
I have no idea if the 49ers are truly guilty, but if they are, then honestly. losing a 5th round draft pick and moving down a few spots in the third round isn’t that huge of a deal. At all. It will not affect their Super Bowl aspirations, playoff aspirations, doormat aspirations, etc.

Edwards doesn’t have substantive evidence to support his insinuations, which is why they don’t qualify as allegations.
Herm Edwards is better at media manipulation than at coaching. In this instance, he’s preemptively blaming the duplicity of others for the difficulties the Chiefs will encounter this season. He’s lowering expectations as fast and as far as possible.

The comish is doing an incredibly poor job of being non-biased towards the different franchises & players.
The NFL has not met with a man whom accuses the Pats of blatant cheating and says he has video to prove his side. The main reason being is he is friendly with the Pats owner. A small fine and cover up does not fix the problem.
Every team tampers before FA each year, but to only fine 1 team, SF, is inexpiable.
KC’s DE Allen had 2 DUI’s and got a mere 2 game suspension. What, get a DUI and lose a game check? Terrible imagine for the league. Now Allen is opening his own bar in KC w/o recourse from the team or league.
The game will always be strong, but if competitive balance is loss due to the commissioner’s friendships to certain owners, that is a real travesty.
